New D.C. zoning rules restricting pop-ups, conversions not yet in effect

The D.C. Zoning Commission's decision to change the rules on single-family conversions is not being enforced, yet.

In the aftermath of the June 8 commission decision, which limits — in the R-4 zoning district only — the maximum height of homes to 35 feet and the maximum number of units to two without a special exception, at least one major media outlet reported the rules would take effect immediately.

They do not. Per the Department of Consumer and Regulatory Affairs, the agency charged with issuing building permits, the regulations will not be implemented until the Office of the Attorney General drafts a notice, which is then reviewed by the Office of Zoning, signed by the zoning director and the Zoning Commission chairman, and then published in the D.C. Register.

That process can take weeks or longer.
