In response to the remand of this proceeding by the District of Columbia Court of Appeals in its opinion Friends of McMillan Park v. District of Columbia Zoning Commission (Nos. 15-AA-0493, 15-AA-0525, 15-AA-0536, 15-AA-0572 and 15-AA-1008) (“the Appeal”), issued on December 8, 2016, the Mayor’s Agent Hearing Officer hereby gives notice of an additional public hearing to be held on March 10, 2017 at 10:00 a.m., at 1100 4th Street SW, Room 650.

It's very important that as many people as possible attend this hearing so that the few who claim to speak for the community do NOT steamroll over the real interest of this region and this city! FRIENDS OF MCMILLAN are no one's friend. This is the most important factor that needs a spotlight. And sadly, the Bloomingdale Blog has been used as their bull horn. Shame on these folks who think they are entitled to dictate to others on this very important project and it's real impact on our community!
ReplyDeleteAnyone wishing to attend the hearing should definitely do so, but I would recommend that they should read the full notice first. The way I read it, and I am not an attorney, the hearing is for the parties in the Appeals Court case. Perhaps individuals can testify, as well, but I would double check before blocking off the day on your calendar.
ReplyDeleteAlso, the scope of the hearing is limited to the certain issues that were noted in the Court order.
Finally, this blog seems open to serving as a voice for any member of the community who has something to share, whether as an original post or uncensored comments. In fact, I am often disappointed by how little participation there is. Most of the comments about McMillan are from two people - one supporter of the project and one opponent of the project, so I can't imagine how anyone could determine the sentiment of the community, solely from reading this blog.

DeleteI decided to look into this.
DeleteThe order clearly states who the parties are in the remand hearing, so I also assumed that requests for new parties would not be considered (the Zoning Commission hearing notice is MUCH more explicit about this). I emailed HPO today to get clarification on whether individuals could testify.
Surprisingly, the response I received from Bruce Yarnall, suggests party application WILL BE CONSIDERED and individuals CAN TESTIFY at the remand hearing.

I believe the Notice sections extracted and copied below provide the answer to your question. Anyone may testify, but if the person testifying wishes to be recognized “as a party to the case” must file a request as stated.

Interested persons or parties are invited to participate in and offer testimony at these hearings. Any person wishing to testify in support of or opposition to the application may appear at the hearing and give evidence without filing in advance. However, any affected person who wishes to be recognized as a party to the case is required to file a request with the Mayor’s Agent at least fifteen days prior to the hearing. This request shall include the following information: 1) his or her name and address; 2) whether he or she will appear as a proponent or opponent of the application; 3) if he or she will appear through legal counsel, and if so, the name and address of legal counsel; and 4) a written statement setting forth the manner in which he or she may be affected or aggrieved by action upon the application and the grounds upon which he or she supports or opposes the application. Any requests for party status should be sent to the Mayor’s Agent at 1100 4th Street SW, Suite E650, Washington, D.C. 20024.

Dear HPO Staff -
I had a question regarding the notice issued for the public hearing to be held on March 10, 2017 before the Mayor's Agent concerning the DC Court of Appeals remand of HPA Nos. 14-393 and 15-133.
Will public testimony pertaining to the remand issues be allowed during this hearing, or will only the named parties be allowed to testify?
