If coming out to a meeting is difficult, please confront rapacious developer dc govt. collusion with financial contributions. There will only be concrete and congestion, we cannot allow successive DC administrations to COLLUDE with connected development conglomerate www.VisionMcMillan.com, to STEAL from us, the DC public, the enlightened work of 19th Century designers and engineers, brought ot DC by Senator James McMillan, the Senate McMillan Plan for DC parks.

 POLITICAL WORK FOR VICTORY: In between the legal work, we'd like to jin up the support of our neighbors using the media, art, letter writing, and other dissent measures to all out oppose the demolition and privatization of McMillan Park.




We can save this 25 acre green oasis in the new concrete jungle of tens of thousands of new  units and paving over the city. For a gracious DC, for  the environment, the kids, for sustainable parks development.

I am writing to ensure you know that the DC Zoning Commission has issued a new Order approving the demolition, privatization, and construction of millions of square feet of new residential/commercial space on our McMillan Park. Some of you are part of the Friends of McMillan Park group, some are part of DC4RD's Save McMillan Action Coalition (SMAC).  Some of you are members of both.

WHAT'S CLEAR IS THAT ALL OF YOU HAVE THE RIGHT TO APPEAL THIS BOGUS DECISION BY THE ZONING COMMISSION (especially if you live within 5 to 10 blocks from the park).

To appeal bad agency decision, like this one, you have clear Administrative Procedure rights pursuant to the DC Code.

An appeal of the MCMILLAN ZONING COMMISSION ORDER: [see attached as well]

WHAT IS REQUIRED

YOUR SIGNATURE & THOSE OF NEIGHBORS: To join the appeal with others, please either sign the Petition for Review directly, or alternatively sign the Letter of Authorization.
REVIEW THE TIMELINE & PARTCIPATE AS BEST YOU CAN: Once signed on and authorizing the appeal, the case will be docketed by the highest Court in the District.

TIMELINE
  • OUR PETITION FOR REVIEW IS DUE BY JUNE 28TH.
    Filing Fees are covered!
  • Within a couple of months after filing our petitions, our first written pleading will be due. An attorney, or, together as a pro se group with help from and in collaboration with other attorneys, we will begin briefing.  All written pleadings will be reviewed and signed off on by Co-Petitioners. To support the pleadings, we can use your help to read the Agency Orders to determine exactly where the Zoning Commission runs afoul of the law, the facts, and basic common sense.
  • Then a month after filing our initial written pleading (The Opening Brief), the Zoning Commission and developers will file their Response briefs.
  • Then a month after that, Co-Petitioners will be allowed to submit a reply brief for the Court to review.
  • Then about 5 months after that, we can argue the case before a panel of Judges at the DC Court of Appeals.  That is when an attorney or a key Petitioner may do the verbal presentation of the case.  Nothing shall be required of Co-Petitioners (YOU), except but to show up to the Court, announce your presence and support of all the presented claims.

  1. The "environment" begins at home. New research demonstrates the healthful effects of not being packed in like sardines, that green space, and open air activities in a city are good.

    1. Urban density is a pretty fundamental part of living in a city. Perhaps the suburbs would suit you better?

  2. The BCA has been turned into a vehicle for the sick obsession of blocking development in a part of this city that is starved of new housing and commercial services and a real park. This self-serving pack of hypocrites need to be stopped. We need to build McMillan Park and stop the obstructionists NOW!
