McMillan developers pick up anothercourt win, though construction remains blocked

One of the developers looking to remake the McMillan Sand Filtration Plant just picked up another win in court, though there are still some barriers remaining before construction can start on the tortured project.
A three-judge panel of
the D.C. Court of Appeals ruled Thursday against a challenge to one piece of
the project, affirming the Zoning Commission’s decision to approve a
residential-over-retail building proposed by Jair Lynch Real
Estate Partners on one of the 25-acre property’s seven parcels.
Executives at Jair Lynch did
not immediately respond to a request for comment on the ruling. James Fournier,
one of the plaintiffs who lives near the Stronghold-area site, said he was
frustrated that the court and the commission have now both refused to consider
“a complete traffic study in any real detail” or the “un-assessed environmental
impacts and real health problems for the people around McMillan” that he
believes would follow the project.
