Stronghold Civic Assn's McMillan concerns; ANC 5C Chair Edwards' response

From ANC 5C07 Commissioner James Fournier:

I`d like to forward for community input the attached letter from the Stronghold Civic Association concerning the proposed McMillan development plans and ANC 5C Chairman Ronnie Edwards` incredible response.

As we all know, there is an important public McMillan Advisory Group meeting this Saturday at The Summit from 2pm-5pm. Commissioner Edwards` response to Stronghold`s concerns, attached below, highlights the importance of attending this meeting.

Without putting too fine a point on it, ANC 5C`s response to the Stronghold Civic Association`s concerns are dismissive and purposefully coerce a ``get in line for your medicine`` response. Yet none - none - of the constituents with whom I`ve spoken support the current proposed development. As the Commissioner in charge of the McMillan site, I have always thought of myself, along with the other Bloomingdale ANC Commissioners, as merely an emissary of constituents` concerns. To be told by the Chair of our ANC that the ANC will vote on development plans regardless of the deep seated concerns of those most affected by the development is very troubling - from both a neighborhood and District-wide perspective. I cannot agree with it.

This Saturday`s meeting at the Summit will discuss some of the first principle problems with the current development plans, including:

(i) the lack of any credible transportation plan to accommodate the high density traffic associated with high rise medical offices, residential properties, and above ground retail malls;

(ii) that the sole stormwater run-off plan solicited by the District states that the well-known flooding occurring throughout Bloomingdale since the 19301s will not worsen under the District`s current plan to pave over McMillan - although DC Water has already conceded that Bloomingdale`s current flooding problems will not diminish for approximately 20 years;

(iii) that there has never been an RFP for the vertical development of McMillan;

(iv) that the current proposed ``developers`` of McMillan are only consultants desperate to become the actual developers following transactions under former Councilman Harry Thomas, Jr.;

Nobody needs to be an engineer to understand that proposing massive, high density development on a 25 acre vacant lot will so increase traffic and flooding throughout Bloomingdale so that the current, non-competiveltle bid plan is unworkable.

Let`s talk at the Summit on Saturday.

Subj: Stronghold Community Association does not support the currently proposed Vision McMillan

Partners plan for development of McMillan Park

The Stronghold Civic Association (SCA) earlier respectfully requested your assistance to delay the March 22 2012 scheduled presentation by the firm Vision McMillan Partners (VMP) to the DC Historic Preservation Review Board (HPRB) of their master development plan, for reasons stated in that letter to you (a copy of which is attached). We thank you for doing so. We understand that the VMP presentation to the HPRB is now scheduled for April 26 2012.

We understand that ANC 5C will meet again to discuss community support (or lack thereof) for the VMP development plan on April 17th. The Stronghold Community Association does not support the current VMP development plan, based on our knowledge of it, or the undue haste or rather irregular procedures used in promotion of this plan. Proposed ten-story buildings in one corner of the site and destruction of much of the park are two particularly strongly felt issues.

The Stronghold Civic Association still feels that we are being pushed to make a decision on a development plan that we do not support, and question the need for such an urgent decision.We have no sitting Ward 5 Councilmember to appeal to, and while we have conferred closely with our own ANC 5C07, who supports our position, there is no sitting ANC 5C04 representing most of our Bloomingdale neighbors.We are aware that neighboring ANCs 5C03, 5C05, and 1B10 share our position on these matters.

We understand that ANC 5C will meet to gather community input on the proposed McMillan development on April 17 2012.The Stronghold community position on this matter remains unchanged from our previous correspondence with you: there is no support for the current VMP plan in the SCA.

In view of the above, SCA cannot support the currently proposed VMP plan for the development of McMillan Park as it is understood, and respectfully requests that you acknowledge this as the Stronghold Community Association position. We would consider further review of this proposed development and process, but the SCA will not meet again until May 7, after the April 17 2012 ANC 5C meeting.

RESPONSE FROM ANC 5C CHAIRMAN RONNIE EDWARDS,

Good Morning,

Thanks very much for your email/letter. I look forward to recieving it once you have accurate information from which to respond. Please know that I appreciate your candor and really look forward to working with you guys to develop a reasonable approach to dealing with the proposed development at McMillan.

Also, please note that - once again - the City has moved the HPRB Hearing Date to May 24, 2012 - which gives us a little more time to consider the application. This was discussed at the MAG meeting last week - unfortunately those in attendance chose not to inform you.

Finally - ANC 5C looks forward to and will acknowledge the position of any and all ANCs/Civic Associations with regards to McMillan. However - at the end of the day - the final decision will be made by a majority of the Commissioners and hopefully with the input of the constituents they represent.

As I discussed at the last MAG meeting - the decision on this will not be unanimous. We must all accept that. It is very unfortunate - and quite frankly - deceptive to try to insinuate that this process is being rushed. After 40 or more years of discussing and re-discussing the proposed development of McMillan - with the full support of our former Councilmember, who was pushing for development - the City has initiated the process to move forward by filing the HPRB Application. Once that happened, its normal that there is a timeline for responding. That's not unique or in anyway different. Its the process.

The fact that 1, 2 or 3 ANCs out of 12 oppose the process - again - nothing unique about that. At the end of the day - because of the process - we will all come together and vote on the application and the majority will prevail. What's unique is that those who are opposed are trying to intimidate everyone else from proceeding.

I am so sorry that you guys feel that way and want to play the game that way - but unless the City withdraws the application - as Chair of ANC 5C I must continue recieving full community input so that we can make an informed decision.

I know that there are those who just want a park over there. But unfortunately, many of us who have been around here for a long time - we want more. We would like to see the area developed and put to a better use for ALL OF US - NOT JUST SOME OF US. Don`t let those who are fighting for a park - with no money - hold you and the entire Ward hostage.

If you guys are really honest - we have a little more time (until May15/22) - and I trust that you will use it to sincerely critique the HPRB Application before us and offer some substantiave comments.

I * think * that ANC 5C voted last night to support the plan to have the McMillan site in a separate ANC from the remainder of Bloomingdale

I attended last night`s ANC 5C meeting held here in Bloomingdale.

At the tail end of the meeting, Commissioner Pinkey submitted a resolution titled ``Resolution on Redistricting and Designation of Six (6) Advisory Neighborhood Commissions WIthin Ward 5.`` I do not know if the full text of this resolution is posted anywhere.

It would appear that the resolution voted on and passed last night supports the plan to have Bloomingdale's McMillan Sand Filtration site in a separate commission -- a separate ANC -- than the remainder of Bloomingdale.

Perhaps one of the commissioners could weigh in and clarify.

Engine Company 12's liquor license pursuit

One of the items on last night`s ANC 5C meeting agenda was "Reconsideration/Finalization of Action Re: Engine Company 12 ABRA Application/Mediation."

Applicant Abbas Fathi did not appear at last night's meeting. ANC 5C03 Commissioner Hugh Youngblood commented that Mr. Fathi had a family emergency and could not attend.

Note that ANC 5C is on record for supporting Engine Company 12. There was discussion last night amongst the commissioners to withdraw that support, but no motion was made to withdraw support.

ANC 5C votes to support HU's campus plan

At last night's ANC 5C meeting, the Commission voted to support the Howard University Campus Plan.

Not too much controversy there.

An Open Letter to the Community
Re: Scheduled Opening of Engine Company 12

To all local residents,

Due to the lack of open support from community leaders and local civic associations, it has become necessary to delay the opening of Engine Company 12 from July 1, 2011 to September 1, 2011. We have tried for the past several months to garner letters of support from local area civic associations and the Advisory Neighborhood Commission without success. Without these letters the process to obtain an alcohol license from the Alcoholic Beverage Regulation Administration is drastically slower. Operating a restaurant of this size without an active ABRA license would be financially unfeasible.

Representatives from Engine Company 12 have been attending and presenting at local area civic association meetings and hosting meet and greets off and on for the past four months. It is unfortunate that this philosophy of open communication with local residents and civic leaders has not garnered the support necessary to yield letters of support from local groups.

If we are unable to obtain letters of support from the local civic associations and the Advisory Neighborhood Commission in the next 30-45 days the opening date will need to be delayed until after the start of the New Year. I apologize for this and we are still working diligently to get this project up and running as quickly as possible.

parking enforcement on the 100 block of T St NW

I am working to address the parking issues on Sunday in Bloomingdale due to church goers that illegally park in the neighborhood. Can you please post something to the blog encouraging folks in the neighborhood to contact Councilman Thomas and their ANC commissioners about the problem? I think the more people drawing attention to this issue the faster it will be resolved.

One can park with immunity in ways on a Sunday morning that virtually any other time will result in a ticket. This means that getting the violations dealt with in the manner you quite vigorously attempted is not likely to have much impact. Second, the Department of Public Works, which handles basic parking enforcement, does not generally do enforcement on weekends in residential areas like Bloomingdale. The areas you note in your e-mail are commercial districts and are handled differently. That said, Parking Enforcement does come out on occasions during the weekend and a request can be made to them to specially come to Bloomingdale on Sunday. However, as I noted, such enforcement would fly directly in the face of long-standing policy. Third, police officers do write parking tickets on weekends, but again they generally will look the other way on a Sunday morning.

So let me offer another suggestion. I have very good relationships with almost all the pastors, rectors, etc. in and around Bloomingdale as well as a very good relationship with Rhode Island-North Capitol Ecumenical Council; most, but not all, of our neighborhood churches are part of the Council. With that in mind, I would like to bring the commissioners and the Bloomingdale Civic Association officers together with the Ecumenical Council and any other church in the area (I think specifically of the Eritrean Christian Church at 2nd & S and World Missions Extension Center at 1st & Randolph NW). In that venue, we can discuss with the ministers the concerns that you and others have raised and look for positive solutions.

The churches are vital and historic parts of this community that have felt less-than-welcome at times by the actions of some neighbors. So it behooves us to approach them in the spirit of mutual respect and in the spirit of positive collaboration to avoid both bad feelings and, more importantly, preventable accident or injury. I am confident that I can arrange that meeting.

But first I will confer with the commissioners and civic association officers to consider solutions and options that we can present to the pastors before we meet with them. Solutions will be important part of the discussion; we'll also want to let them know about the soon-to-open Flatiron Building across T Street from you; the repopulating of that building will only exacerbate the parking shortage. So a little strategic, early, and thoughtful discussion on our part would be helpful.

In the mean time, I am glad that you brought up the photos that you have taken. Please save them. Perhaps we can turn photos into a PowerPoint presentation to show how the parking issues are creating some dangerous situations around the neighborhood. I'll be back to you about those.

Thank you for raising this matter, Brice. Parking continues to be a real problem for the neighborhood. Our businesses, although they don't actually generate much of a parking problem currently, are regularly accused of contributing to a parking shortage in the neighborhood that is almost completely attributable to the positive growth in the neighborhood over the past 15 years. Bloomingdale has almost no vacant homes any more, and many houses have been divided in multiple units. That's the basis of our parking issues. But as our neighborhood continues to grow and our businesses continue to thrive, the shortage of parking is going to become a greater and great concern.

So please give me and the others a little time to come together and then to meet with the pastors. Please continue to document significant parking violations. Contact me any time with information, questions, and requests for updates.

I moved into a condo at 125 T ST NW, in May of 2010. Since that time, I have noticed that every Sunday parking between the hours of 10am and 3pm becomes an issue due to persons attending the various neighborhood churches. Today, the parking violations committed by these individuals elevated to becoming a safety hazard for residents including me. At the intersection of 2nd and T St, cars were parked in clearly visible "No Parking" areas. These cars were even parked in such a manner as to partially be blocking T St NW. After also noticing cars parked in the bus stop at 2nd and Rhode Island Avenue, I proceeded to make a report via the 3-1-1 website to report the violations. When I returned home a few hours later, I noticed that all of the vehicles were still illegally parked and no one from DC parking enforcement or the police had come through to ticket these vehicles. When I called 3-1-1 this afternoon to again make another report of the illegally parked vehicles, I was informed by the 3-1-1 operator that there is no parking enforcement on Sundays. I know this to be false, because on numerous Sundays when I am out in Chinatown or Dupont, I have observed and on at least one occasion, been the recipient of a parking ticket in these areas. If these areas of DC are able to have their parking enforced on a Sunday, why am I not able to have parking enforced in my neighborhood? None the less, when I called 3-1-1 this afternoon, I was eventually connected with 9-1-1. The dispatcher told me that the police would be dispatched. After several more calls, I never saw a police officer come through and I did not observe any of the vehicles receive a ticket for their illegal parking.

After placing my third call to 3-1-1/ 9-1-1 for parking enforcement, I decided to walk through the neighborhood and take pictures of the illegally parked cars. I have approximately 20 pictures showing how many vehicles were illegally parked in this two block radius. I am willing to provide these pictures to you in hopes of illustrating for you just how bad this issue is. I hope this can be resolved this week, if not please know that I will continue to contact 3-1-1 (and if needed 9-1-1) until this situation is addressed and resolved.
