The D.C. Court of Appeals has issued a potentially precedent-setting opinion that not only tosses the Zoning Commission’s approval of a controversial Brookland development, but also may force the commission to change the way it reviews and OKs projects.

The court on Thursday vacated, for the second time, the commission’s June 2012 approval of a planned-unit development slated for 901 Monroe St. NE in Brookland, on a 60,000-square-foot parcel two blocks from the Brookland-CUA Metro station. The project — from the Menkiti Group, Esocoff & Associates, Horning Brothers and Jim Stiegman — was approved for more than 200 apartments and 13,000 square feet of retail. The site includes the Colonel Brooks Tavern, which closed in 2012.

DC Court of Appeals cancels 901 Monroe PUD; will this impact the McMillan PUD perhaps ?

DC Court of Appeals has flat out cancelled 901 Monroe PUD in #Brookland. Might be a first. http://www.dccourts.gov/internet/documents/15-AA-979.pdf …

Michael Neibauer ‏@WBJNeibs 2m2 minutes ago

Court sided with "200-footers" who argued proposed 901 Monroe was medium density, not moderate density. Instead of remanding, PUD denied.

Decision should give hope to other groups fighting PUDs in the courts. There's one in particular I'm thinking of. It starts with Mc.

This would be the crime that occurred on the 1700 block of 4th Street NW.

A woman unloading groceries from a car occupied by her child was robbed at gunpoint of her purse, phone and diaper bag Tuesday afternoon in Northwest Washington’s Truxton Circle neighborhood, D.C. police said.
“Give me everything,” the victim said her assailant yelled at her, as he pointed a silver handgun. After stealing the items, police said the gunman drove off in an older-model blue-green van.
The daylight holdup in a residential area off Rhode Island Avenue NW was among at least a dozen robberies reported in the District since Tuesday.

Latest for McMillan: More Concrete
Thursday Hearing Before Historic Preservation Board

The DC Historic Preservation Review Board this Thursday, tomorrow, to  consider revised plans for the 2-million-plus square feet development of the 25-acre McMillan Park.  The new plans show that the public amphitheater including a large stream and public pond, is to be replaced with concrete pavers.

Before:

After:

Most shocking is the complete disappearance of the central water wells and the central fountain that were originally proposed to be integrated into and around the existing McMillan sand silos. These too have been replaced with more concrete pavers and stone stairwells, without explanation for this change in design.

Original central water fountain:

These water features were among the few connections to McMillan’s clean-water history as a national and local landmark.

Despite widespread resident opposition and lawsuits, as well as fundamental District of Columbia planning documents showing that vast majority of the historic McMillan Park should remain as open public space, two years ago the DC Historic Preservation Review Board approved a project that destroys nearly 20 acres of historically significant underground water cells, and paves over more than two-thirds of the 25-acre park with 2+ million square feet of high-density commercial and residential redevelopment at the intersection of North Capitol and Michigan Avenues in Northwest DC.

The HPRB will meet to discuss changes to the plans from two years ago, this Thursday at 441 4th Street NW, Room 220 South; the schedule calls for McMillan to come up at 1:45 pm.

Individuals and organization representatives are strongly encouraged to attend this meeting and express their opposition to the new change in design.

dirt bikes on Florida Avenue yesterday evening

See this 05-25-2016 message from a Florida Avenue NW resident:

Last night, just after rush hour, those of us who live in the unit block of Florida Ave., NW were treated to a horde of dirt bikes and ATVs numbering about 20 which descended upon us from the East. The bikes and ATVs were operated by young men wearing ski masks covering all but their eyes. Traffic came to a standstill as the machines zipped up and down the street performing stunts (wheelies and crossovers) at great speeds. The noise was deafening and the maneuvering and speed on the sidewalks and through the alleys exhilarating. The machines were brightly colored and appeared to be brand-new. Adding to the excitement was the dirt and flowers flying from the tree boxes and the pedestrians cowering into the stairwells. The performance lasted about 5 minutes and rivaled scenes we typically see in an action movie depicting bad bikers terrorizing a community. Of course, this was reality and just a bunch of young guys out having fun, although it was a little disconcerting watching them pull down the masks over their faces. We thought it was so entertaining that we called 911 so that MPD could come and enjoy the show with us. They must have been busy because none appeared except the one that had been sitting in the gas station while all of this was going on (I wonder if the squad car got dirty when the bikes and ATVs dug up the gas station lawn spewing dirt everywhere). It must’ve been very exciting for that police officer to be so close to the action. Finally, the bikes left in the direction of U Street and we were able to get back to watching the Nats game. In hindsight, I wish I had recorded it and passed it on to the developers of all the new condos going up in the block. Perhaps a little lawlessness would be good for sales. Anyway, it sure sounds like the beginning of an exciting summer.
