Commissioners Quinn, Barnes, Edwards, and Turner,

Good afternoon. On behalf of the Applicant, please find attached the final proffer list and revised draft order for the McMillan Parcel 2 Second-Stage PUD (Z.C. 13-14A) that were filed this afternoon as required under Section 2403 of the Zoning Regulations. The final list of proffers reflects comments received from the Office of the Attorney General (OAG), on Monday, February 29, 2016. The attached revised draft order reflects the Commission’s proposed action taken on February 8, 2016, approving Option B of the final plans with flexibility in the final programming of a portion of the ground floor); the Commission’s stated preference to have the two additional affordable dwelling units (ADUs) proffered by the Applicant devoted to households earning no more than 50% of the area median income (AMI), which the Applicant is committing to; and changes made to the proffer list in response to OAG’s comments. Pursuant to Section 2403 of the Zoning Regulations, the ANC has seven days to respond to the final proffer list, if desired.

Also attached to this correspondence is a revised ADU diagram which reflects the Applicant’s commitment to devoting the two additional ADUs to households earning no more than 50% AMI.

Hardcopies of all of the attached documents will be hand delivered to you tomorrow morning. Final action on the case is scheduled for March 14th.
