Just a reminder that the Office of the Zoning Administrator (OZA) at the Department of Consumer and Regulatory Affairs (DCRA) is seeking public feedback on the documents below. In order to provide as
to what constitutes a dwelling unit, especially in situations where a ‘wet bar’
is provided in a portion of a building [such as a basement] that has a separate
means of access and a full bathroom, that could then be utilized as a separate
dwelling unit, this proposed guidance is the Office of Zoning Administrator’s
interpretation of the Zoning Regulations [Title 11 of the DCMR] as it applies
to the presence and configurations of rooms within a residential building. This
guidance applies to the review of building permit applications for zoning
compliance only. All other applicable District regulations, including
Construction Code requirements (Title 12A of the DCMR), are not governed by
this guidance.
