Engine Company 12's liquor license pursuit

One of the items on last night`s ANC 5C meeting agenda was "Reconsideration/Finalization of Action Re: Engine Company 12 ABRA Application/Mediation."

Applicant Abbas Fathi did not appear at last night's meeting. ANC 5C03 Commissioner Hugh Youngblood commented that Mr. Fathi had a family emergency and could not attend.

Note that ANC 5C is on record for supporting Engine Company 12. There was discussion last night amongst the commissioners to withdraw that support, but no motion was made to withdraw support.

ABRA approves Capitol Food Mart Class B license - with some restrictions

The ABC board finally released its decision today on the Capitol Food Mart alcohol license (1634 North Capitol Street NW) that was opposed by a large group of neighbors. I was the group representative at the protest hearing in July over concerns about public safety, loitering, trash, public urination, and other social problems relating to the overconcentration of stores selling alcohol in the area.

The ABC board acknowledged some of our concerns but approved the Class B beer-and-wine license anyway. However, the store is banned from selling single bottles and cans of beer or malt liquor, and the store owner promised to not devote more than 15 percent of the store`s floor space to alcohol sales. I hope those concessions will limit some of the negative impacts.

Somehow the board didn`t find there was an overconcentration of alcohol outlets, but the decision just mentions other Class B convenience stores, not the huge number of liquor stores already in the neighborhood. Thank you to everyone who took part in the protest! I think we can call it a success even if it wasn`t an outright victory.

Procedural Protest of the Engine Company 12 ABRA Application

Dear Members of the Community,

The Engine Company 12 team has indicated their preference to negotiate a Voluntary Agreement with the surrounding community regarding their ABRA application under the leadership of the ABRA mediator. As such, I`ll be working with Commissioners Pinkney and Thomas and any interested members of the community to develop and submit a protest petition to ABRA in order to formally initiate the structured mediation process.

If you`d like to join the working group on the subject, please contact either me, your SMD Commissioner (if you live outside the borders of SMD 5C03), or your local Civic Association leaders.

If you`d like to show your support for the Engine Company 12 ABRA application as filed, please let me know and contact Mr. Steven May to determine how the team could best use your help.

On behalf of District of Columbia Single Member District 5C03, I am writing this letter of support for the Engine Company 12 ABRA application.

The majority of SMD 5C03 community residents support the general advancement of the Engine Company 12 project as presented at local community meetings held during 2011, and we recognize that alcohol sales comprise a critical revenue stream to ensure the economic sustainability of a restaurant of the proposed size and scope.

The Engine Company 12 project team has conducted diligent outreach efforts within the SMD 5C03 community. Despite these efforts, some outstanding concerns remain with various members of the community with regard to specific parameters of the Engine Company 12 ABRA application and other operational aspects of the proposed business.

The SMD 5C03 community provides this letter of support in advance of reviewing the parameters of the Engine Company 12 ABRA application in the spirit of good faith that the Engine Company 12 development team will voluntarily return to the negotiating table to reach an agreement with the community that both respects residential concerns and provides sufficient entrepreneurial flexibility to facilitate positive socio-economic transformation.

The DC Alcoholic Beverage Control (ABC) Board has issued a ruling that allows Hank’s Oyster Bar to operate without a voluntary agreement (V.A.). The 4 to 2 vote follows a six-hour hearing on Oct. 13. (See 6-Hour Hearing But No Decision for Hank’s Oyster Bar.)

Borderstan learned of the ABC Board’s ruling today at a Board hearing on another matter related to Hank’s — its request to expand into an adjoining space. You can read the ABC Board ruling (PDF).

Owner and chef Jamie Leeds signed the V.A. before opening in 2005, with a group of neighbors and the Dupont Circle Citizens Association (DCCA). Leeds asked to be released from the V.A., which she could do after five years.

The protesting residents argued that a bad precedent would result if Hank’s were allowed to operate without a V.A. A number of other liquor-serving establishments on 17th St. already operate without one.
