Stronghold Civic Assn's McMillan concerns; ANC 5C Chair Edwards' response

I`d like to forward for community input the attached letter from the Stronghold Civic Association concerning the proposed McMillan development plans and ANC 5C Chairman Ronnie Edwards` incredible response.

As we all know, there is an important public McMillan Advisory Group meeting this Saturday at The Summit from 2pm-5pm. Commissioner Edwards` response to Stronghold`s concerns, attached below, highlights the importance of attending this meeting.

Without putting too fine a point on it, ANC 5C`s response to the Stronghold Civic Association`s concerns are dismissive and purposefully coerce a ``get in line for your medicine`` response. Yet none - none - of the constituents with whom I`ve spoken support the current proposed development. As the Commissioner in charge of the McMillan site, I have always thought of myself, along with the other Bloomingdale ANC Commissioners, as merely an emissary of constituents` concerns. To be told by the Chair of our ANC that the ANC will vote on development plans regardless of the deep seated concerns of those most affected by the development is very troubling - from both a neighborhood and District-wide perspective. I cannot agree with it.

This Saturday`s meeting at the Summit will discuss some of the first principle problems with the current development plans, including:

(i) the lack of any credible transportation plan to accommodate the high density traffic associated with high rise medical offices, residential properties, and above ground retail malls;

(ii) that the sole stormwater run-off plan solicited by the District states that the well-known flooding occurring throughout Bloomingdale since the 19301s will not worsen under the District`s current plan to pave over McMillan - although DC Water has already conceded that Bloomingdale`s current flooding problems will not diminish for approximately 20 years;

(iii) that there has never been an RFP for the vertical development of McMillan;

(iv) that the current proposed ``developers`` of McMillan are only consultants desperate to become the actual developers following transactions under former Councilman Harry Thomas, Jr.;

Nobody needs to be an engineer to understand that proposing massive, high density development on a 25 acre vacant lot will so increase traffic and flooding throughout Bloomingdale so that the current, non-competiveltle bid plan is unworkable.

Let`s talk at the Summit on Saturday.

Partners plan for development of McMillan Park

The Stronghold Civic Association (SCA) earlier respectfully requested your assistance to delay the March 22 2012 scheduled presentation by the firm Vision McMillan Partners (VMP) to the DC Historic Preservation Review Board (HPRB) of their master development plan, for reasons stated in that letter to you (a copy of which is attached). We thank you for doing so. We understand that the VMP presentation to the HPRB is now scheduled for April 26 2012.

We understand that ANC 5C will meet again to discuss community support (or lack thereof) for the VMP development plan on April 17th. The Stronghold Community Association does not support the current VMP development plan, based on our knowledge of it, or the undue haste or rather irregular procedures used in promotion of this plan. Proposed ten-story buildings in one corner of the site and destruction of much of the park are two particularly strongly felt issues.

The Stronghold Civic Association still feels that we are being pushed to make a decision on a development plan that we do not support, and question the need for such an urgent decision.We have no sitting Ward 5 Councilmember to appeal to, and while we have conferred closely with our own ANC 5C07, who supports our position, there is no sitting ANC 5C04 representing most of our Bloomingdale neighbors.We are aware that neighboring ANCs 5C03, 5C05, and 1B10 share our position on these matters.

We understand that ANC 5C will meet to gather community input on the proposed McMillan development on April 17 2012.The Stronghold community position on this matter remains unchanged from our previous correspondence with you: there is no support for the current VMP plan in the SCA.

In view of the above, SCA cannot support the currently proposed VMP plan for the development of McMillan Park as it is understood, and respectfully requests that you acknowledge this as the Stronghold Community Association position. We would consider further review of this proposed development and process, but the SCA will not meet again until May 7, after the April 17 2012 ANC 5C meeting.

RESPONSE FROM ANC 5C CHAIRMAN RONNIE EDWARDS,

Good Morning,

Thanks very much for your email/letter. I look forward to recieving it once you have accurate information from which to respond. Please know that I appreciate your candor and really look forward to working with you guys to develop a reasonable approach to dealing with the proposed development at McMillan.

Also, please note that - once again - the City has moved the HPRB Hearing Date to May 24, 2012 - which gives us a little more time to consider the application. This was discussed at the MAG meeting last week - unfortunately those in attendance chose not to inform you.

Finally - ANC 5C looks forward to and will acknowledge the position of any and all ANCs/Civic Associations with regards to McMillan. However - at the end of the day - the final decision will be made by a majority of the Commissioners and hopefully with the input of the constituents they represent.

As I discussed at the last MAG meeting - the decision on this will not be unanimous. We must all accept that. It is very unfortunate - and quite frankly - deceptive to try to insinuate that this process is being rushed. After 40 or more years of discussing and re-discussing the proposed development of McMillan - with the full support of our former Councilmember, who was pushing for development - the City has initiated the process to move forward by filing the HPRB Application. Once that happened, its normal that there is a timeline for responding. That's not unique or in anyway different. Its the process.

The fact that 1, 2 or 3 ANCs out of 12 oppose the process - again - nothing unique about that. At the end of the day - because of the process - we will all come together and vote on the application and the majority will prevail. What's unique is that those who are opposed are trying to intimidate everyone else from proceeding.

I am so sorry that you guys feel that way and want to play the game that way - but unless the City withdraws the application - as Chair of ANC 5C I must continue recieving full community input so that we can make an informed decision.

I know that there are those who just want a park over there. But unfortunately, many of us who have been around here for a long time - we want more. We would like to see the area developed and put to a better use for ALL OF US - NOT JUST SOME OF US. Don`t let those who are fighting for a park - with no money - hold you and the entire Ward hostage.

If you guys are really honest - we have a little more time (until May15/22) - and I trust that you will use it to sincerely critique the HPRB Application before us and offer some substantiave comments.

After my previous posting I received the following correction from a fellow community member. Although the contract that was awarded to EYA after EYA made its $55,000 contribution to CM Thomas` ``Ward 5 Business Council`` was not to the McMillan project but rather to St. Paul`s College, nevertheless EYA received the contract after making that contribution and later was selected to become the developer of the McMillan project as well.

``EYA eventually contributed $55,000 to Thomas`s Ward 5 Business Council, which had Vicky Leonard, Thomas`s right hand, as the treasurer, until the Office of Campaign Finance admonished him for that. Also, the vote the following day was not about McMillan but about approving the St. Paul`s College construction project (which breaks ground next week). The College is building homes on its property to raise money; EYA is the developer. The City Council approved the project over the objections of the ANC.``

In addition, here is more information about relations between the City and EYA--behind the scene of the McMillan project:

The manager of the McMillan project at the Office of the Deputy Mayor for Planning & Economic Development of the DC Government is Mr. Clint Jackson*. The VP of EYA is Mr. Aakash Thakkar**. Mr. Jackson and Mr. Thakkar used to work for the National Capital Revitalization Corporation (NCRC). They worked on the NCRC approach to getting McMillan developed, which started in 2006. NCRC picked the Vision McMillan Partners (of which EYA is the lead partner) to be the site developer. After Adrian Fenty became Mayor, he dissolved NCRC and McMillan became part of the portfolio of projects of the Deputy Mayor for Planning and Economic Development. At that point, Aakash went to work for EYA and Clint went to the Deputy Mayor`s office.

I hope you will be able to come to the meeting on Thursday and/or let me know that you are interested in being involved in saving the McMillan sand filtration site. We are forming a group to take immediate action. What we don`t have at this time is a huge number of people who have joined us. This is a once-in-a-lifetime opportunity to be able to save such a magnificent historic construction, while making a significant impact in helping to improve processes in the DC Government. If you can think of a reason this is not the time to act, please share this with us. Otherwise, please let me know that at least you are willing to add your name to the petition of citizens against demolition of McMillan and against the McMillan project by extension.

My Fellow DC Citizens:

1. At around 12:20 PM today (Wednesday, August 25, 2010), two DC detectives knocked on my door. I invited them in and we talked for about half an hour. They were here based on a complaint that CM Thomas had filed against me with the DC Police for what I did while he was talking in Gray`s fundraising campaign this past Sunday. (I told him he is a liar and corrupt after he told the audience his Nth lie, deception, meaningless and misleading words, and trying to appeal to people`s emotions even by putting his mom on the stage. I did ask him to let me ask him one question but he didn`t let me.

This issue of officials and politicians being able to say anything that they want but people not being able to ask their questions exactly when they say their lies—so everyone who hears their lies can also hear the other side of the story — is one of the biggest devastating weapons that the politicians and officials have that they are using against people and to their own advantage.

My issue with CM Thomas has to do with his role in the destruction of McMillan sand filtration project. Just a brief history, as you may know, CM Thomas received $50,000 (?) or so for something (I don`t know exactly for what) from

EYA (construction company) and the next day (as I am told) EYA was selected as the main developer of McMillan. Ever since CM Thomas has been one of the solid supporters of the McMillan ``project`` that will result in the demolition of at least 99% of McMillan historic sand filtration, and packing its graveyard with 1200 residential units and massive commercial space, without having done any studies of cost/benefit to people, environment, quality of life, side effects, additional devastation to skyrocketing budget deficit, etc. etc.

And the worst part is that the City, CM Thomas, Mayor Fenty, and everyone else involved in this ``project`` is not showing us (MAG representatives of people—to which, as of January of this year I became a member of) any of the documents and contracts. They are also not answering any of our critical questions. The City, with the help of a number of officials and politicians has pushed this devastating plan forward for the past three years and is now very close to sealing the deal. Most probably if it weren`t for the upcoming elections, they would have sealed the process, which would have been the end of McMillan.

2. One of the strategies of the City for making sure that they can get this project done the way they want (that is only about maximizing profit for the developer at astronomic losses to people), has been to eliminate people`s effective input into the planning process. To that end, they created a group of ``representatives`` called MAG (McMillan Advisory Group), but a) made it completely powerless in any decision making (by giving it just a puppet role), and b) closed the meetings with this group to public attendance. As a result, the City, EYA, CM Thomas, and others used MAG in their speeches countless times stating that people have been involved in the development of the ``EYA Plan`` every step of the way, when in reality, that was just a complete and shameless lie.

After I started looking into who had decided to close MAG meetings to the public, the City blamed it on the MAG itself. When I shared that response with MAG, one of the MAG members wrote the history of the events to show that it was in fact the City and the developer who had established the closed-door strategy. After those discussions the City ``agreed`` to allow public participation in the MAG meetings, with the condition that the public will not be allowed to even speak, let alone ask questions. (Even though it must be the other way around--people must be the decision makers for public projects and not the City--but that is another issue).

3. MAG is meeting with the City and developers of McMillan project this Thursday, August 26, 2010, at 7:00pm at All Nations Church in Bloomingdale (2001 North Capitol Street Northeast, Washington, DC 20002-1327 (202) 832- 9591). Agenda is to discuss the two ``study reports`` that the City claims they have done related to McMillan project. These are historical study and fiscal impact reports. I will be happy to send them to you if you send me an email so you can review those reports. These are probably the most critical moments in the life of McMillan sand filtration that will result in its preservation or loss forever.

Please come to this meeting, despite the short notice, to see what the City and developers present, and what their strategy is. We need all this information to do our own analysis and strategizing. Other efforts to save McMillan, our tax monies, environment, and quality of life that depend on this project are happening. But no one has stopped the City from pushing forward. This is our last chance to stop this project. We have several VERY good claims against the City and against this project that can stop this avalanche, but ONLY if we join hands and show huge numbers of people.

I know from experience that one or a few people will be crushed by the City (as they have tried to do to me for the last year—by framing me, lying to others about me, contacting my employer last week to report the only incident of me having used my university email back in May by mistake in a communication with the community and City officials related to McMillan, and now sending detectives to my door).

If you are serious about saving McMillan and helping to clean our DC Government, please come to the meeting Thursday night August 26 and take notes of your questions and observations. Then let us have our own meetings to strategize and win this case. If we win and save McMillan, that would be a major step in starting to change and improve how recklessly the DC Government operates.

This Wednesday, 9/9/2009, there will be a meeting on the development of the McMillan Sand Filtration site (and not the McMillan Reservoir site, which reporters consistently confuse!).

Note that this meeting is NOT NOT NOT being coordinated by the Office of the Deputy Mayor for Planning & Economic Development (DMPED) and the Vision McMillan Partners land development team which has put on the prior community meetings.

It should also be noted that the members of the McMillan Advisory Group (MAG) are not a sponsor of this event.

No agenda for this meeting has been provided.

A few weeks ago, I announced a community meeting about the McMillan Sand Filtration Site. But because a number of key people were not able to make that date, I postponed the meeting. But now with the help of a new host committee, the meeting has been rescheduled and revamped into a series of meetings.

So on behalf of the host committee consisting of several ANC commissioners, community associations, and residents, I invite you to the attend the first of these meetings to discuss the future of the Sand Filtration Site. This meeting is set for Wednesday, September 9, 2009 at St. George's Episcopal Church, at 2nd & U Streets, NW, starting at 7:00 p.m.

This first meeting will cover some history, the results of a previous community input process in 2000, a slide show of the site, the current development plan that has been discussed over the last year, and other options for developing such a site. While this meeting will mainly present broad information, it will lay the foundation for succeeding ones, which will cover more technical issues and offer ways for participants to develop a consensus for what they would like to see happen at the site.

Because the future of the Sand Filtration Site is complex issue and sometimes contentious, we will have a professional facilitator who will run the meetings.

Also, come early. St.George's only seats about 100 people!

The Office of the Deputy Mayor for Planning and Economic Development and Vision McMillan Partners will hold two site tour(s) of the McMillan Sand Filtration Site on Fridays, October 12 and 26 at 4:30 p.m. If you are interested in attending, please RSVP to me via email by COB Thursday, October 11 for the tour on the October 12 or Friday, October 19 for the tour on October 26. You will find the announcement attached.

Please note that all tour participants must sign a liability waiver that will be sent electronically to all whom RSVP.

NOTE: The tour will begin at entrance to the site on First Street.
Parking is available along First and Channing Streets.

All attendees must sign liability waivers to participate in the tours. Liability waivers will be sent electronically to all whom RSVP.
